**SMARTEDTECH SL**, NIF **B66970831**, Carrer Agricultura, 16, 1º, 9ª, 08320 El Masnou, Barcelona, Spain; Registro Mercantil de Barcelona, Tomo 45858, Folio 103, Sección 8, Hoja B-501172, Inscripción 1; legal@vitrinoro.com.
Before any marketplace is commercially opened, separate marketplace terms must address ranking, differentiated treatment, data access, suspension/termination reasons and complaint handling to the extent applicable. Marketplace, checkout and payment collection are not activated by these policies.
5.2 United States
Electronic acceptance and retained reproducible copies are intended to satisfy applicable electronic-signature and records law. Where a U.S. state privacy law applies, covered residents may exercise its rights through legal@vitrinoro.com. Vitrinoro does not sell personal data or share it for cross-context behavioural advertising under this version. If that practice changes, Vitrinoro will provide the required notice and opt-out mechanism before the change. Commercial email sent by Vitrinoro must accurately identify the sender, avoid deceptive headers/subjects, provide the required postal identity and honour opt-outs. Businesses remain responsible for their own campaigns.
The copyright process is described above. No §512 safe-harbour claim is made before designated-agent registration and operational validation.
5.3 Canada and Québec
Vitrinoro applies accountability, identified purposes, appropriate consent, limited collection/use/disclosure/retention, accuracy, safeguards, openness, access and complaint handling where PIPEDA or applicable provincial law applies. Commercial electronic messages must have the required consent or other lawful basis, sender identification and working unsubscribe method; publication acceptance does not create marketing consent.
For a Québec customer, the complete French version of the contract and related documents must be presented first. Only after delivery of the French version may the customer expressly choose another language where permitted. No fee is charged for the French version.
5.4 Türkiye
Where Law No. 6698 applies, the relevant notice must identify the controller, purposes, recipients, collection method/legal basis and data-subject rights. Vitrinoro and each Business remain responsible for their actual controller/processor roles. Cross-border transfers use an applicable adequacy decision, appropriate safeguard including the approved standard-contract route, or another lawful mechanism.
Businesses remain responsible for their own electronic-commerce and commercial-message obligations under Law No. 6563 and related rules. Vitrinoro may remove or disable content and preserve or disclose records when required by Law No. 5651 or a binding authority/court order. Publication of this Addendum does not itself constitute a representation that a Türkiye hosting-provider notification, local representative or traffic-data obligation applies or has been completed; SMARTEDTECH SL must make and document that operational determination for the actual architecture.
