Terms of Service

1. Service description

Vitrinoro is a guided studio operated by SMARTEDTECH SL for small businesses. It lets a business publish a complete presence: a website, an installable web app (PWA), services, opening hours and a booking surface, with five-language chrome (Spanish, English, French, German and Turkish). The design model is 3 site architectures × 7 visual systems × 3 motion scenes.

Vitrinoro is not an App Store or Google Play native app. It is not a generic one-page website builder. It does not make binding decisions for your business: you review and publish your site. Bookings, contact forms, calendar sync and messaging are described in the product; they are only live where the product shows them as connected.

2. Account registration

You must provide accurate business and contact information. The person who creates the account is the initial workspace owner. You are responsible for keeping your credentials secure. Notify us immediately at security@vitrinoro.com if you suspect unauthorised access.

Creating an account is a contract: you must accept these Terms and acknowledge the Privacy Policy. You must confirm your email before the studio opens.

3. Subscription and billing

Plans are Starter, Pro and Plus, billed monthly or annually. The prices shown on vitrinoro.com are the current catalogue. We may change prices with 30 days’ notice for the next renewal. Payment is processed by Stripe. Vitrinoro does not store card numbers.

A plan is active only after Stripe confirms the charge by signed webhook. A checkout redirect does not by itself activate a subscription. If a payment fails, publication follows the subscription status recorded after Stripe’s webhook (including past_due and cancelled).

Extra sites beyond the included site require token packs (50 or 100 tokens). Only an active or trialing Pro or Plus subscription may buy tokens. Tokens are credited only when Stripe confirms payment. Each extra site reserves 50 tokens while the site exists. Refunds and chargebacks adjust the ledger; they do not silently delete a customer site.

4. Refunds and cancellation

You may cancel a subscription at any time through the Stripe Customer Portal. Access continues until the end of the paid period.

Annual plans may be refunded within 14 days of purchase if no extra site has been created and no token pack has been credited. Token packs may be refunded before those tokens are allocated to a site. After allocation, unused available tokens may be refunded on request to legal@vitrinoro.com; reserved tokens stay reserved while the site exists.

5. Data ownership

Your business content (site copy, services, hours, photographs you upload, and similar studio data) remains your intellectual property. We host it to provide the service. We do not sell it. We do not use it to train AI models.

Account deletion is recorded first, then reachable data is deleted and leftovers are retried. We aim to complete deletion within 30 days. Billing records required for tax law may be retained as required by Spanish law. The token ledger is an accounting record and is not deleted merely because a site is unpublished.

6. Acceptable use

You agree not to use Vitrinoro to publish illegal or harmful content or content that infringes third-party rights; to bypass authentication, authorisation or payment controls; to reverse-engineer the service except as permitted by law; to share account credentials; or to impersonate another person or business.

7. AI output

Any AI-assisted text or suggestions in the studio are drafts for you to review. They are not legal, tax, medical or regulated advice. You decide what to publish. SMARTEDTECH SL is not liable for business decisions you make based on drafts.

8. Service availability

We aim to keep Vitrinoro available. We do not commit a numeric uptime SLA in these Terms. We are not liable for downtime caused by subprocessors named in the Privacy Policy and DPA (including Supabase, Vercel and Stripe).

9. Limitation of liability

SMARTEDTECH SL’s total liability under these Terms is limited to the amount you paid for Vitrinoro in the 12 months preceding the claim. We are not liable for indirect, consequential or punitive damages, except where Spanish law forbids that limitation.

10. Termination

You may stop using the service and cancel as described above. We may suspend or terminate an account that violates these Terms, with notice except where delay would create a security or legal risk.

11. Governing law

These Terms are governed by the laws of Spain. Disputes are subject to the courts of Barcelona, without prejudice to mandatory consumer venue rules that apply to you.
