Content, Notices and Appeals

4.1 General and EU notices

A person may report allegedly illegal or prohibited content at `/legal/report-content` or legal@vitrinoro.com. The report should include: the exact URL/location; a clear explanation of why the content is illegal or violates the AUP; supporting law/evidence where available; the reporter’s name and email except where law permits anonymity; and a good-faith statement that the information is accurate. The channel must acknowledge receipt electronically.

Vitrinoro will assess sufficiently precise notices, may request missing information, preserve relevant evidence and communicate its decision where required. If Vitrinoro restricts hosted content or an account, it will provide the affected Business a clear statement of reasons unless prohibited by law or urgent security needs, including the action, factual/contractual or legal basis, material use of automation and available appeal route. Appeals are reviewed by a person not responsible for the original decision where reasonably practicable.

For the EU Digital Services Act, legal@vitrinoro.com is the published user and authority contact channel; communications are accepted in English and Spanish. This policy does not claim that Vitrinoro is an “online platform” or a VLOP, nor does it waive exemptions or obligations determined by the actual service and scale.

4.2 Copyright and United States notices

Copyright owners may send a notice identifying the copyrighted work, the allegedly infringing material and its location, the complaining party’s contact details, the required good-faith and accuracy statements, and a physical or electronic signature. The affected user may submit a counter-notice containing the removed material/location, the required good-faith statement, consent to the applicable U.S. federal-court jurisdiction where required, contact details and signature. Vitrinoro may forward notices and counter-notices and may restore content where legally permitted.

Vitrinoro maintains a repeat-infringer policy appropriate to the circumstances. **SMARTEDTECH SL does not represent in this version that it has completed U.S. Copyright Office designated-agent registration or that it qualifies for 17 U.S.C. §512 safe-harbour.** Registration and renewal are separate operational steps. Copyright correspondence may nevertheless be sent to legal@vitrinoro.com.

4.3 Canada and other jurisdictions

Where Canada’s notice-and-notice regime applies, Vitrinoro may preserve and forward a compliant notice without treating it as proof of infringement. Notices from other jurisdictions are assessed under applicable law, the AUP and the rights of affected users.

4.4 Emergency and authority requests

Requests from law enforcement or authorities must identify the authority, legal basis, scope and official contact. Vitrinoro may verify authenticity and challenge overbroad or unlawful requests. Immediate threats to life or safety should first be reported to local emergency services and may also be sent to legal@vitrinoro.com with “URGENT SAFETY” in the subject.
